1. About Us
1.1 These terms and conditions apply to Studio Scratch Ltd, a company registered in Scotland, trading as 'Studio Scratch' ("the Company"). Registered office: Suite 102, 36 Washington Street, Glasgow G3 8AZ. Company Registration No: SC824680. VAT No: 486884322.
1.2 These terms govern the sale of all products ("Products") by the Company.
1.3 By placing an order, you agree to be bound by these terms.
1.4 Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015.
2. Products & Descriptions
2.1 We take all reasonable care to ensure that details, descriptions, and prices are correct. Products we supply will be of satisfactory quality and fit for purpose.
2.2 Material Honesty & Artisan Nature: Our products feature hand-finished elements. Customers acknowledge that hand-hammered aluminium, acid-etched brass, and hand-patinated copper will have natural, unique variations.
2.3 Industrial Intent: Studio Scratch specializes in an industrial aesthetic. Products may feature intentional raw finishes, including visible weld points, heat discoloration, and surface pitting. These are deliberate design choices and are not considered manufacturing defects.
2.4 Natural Patina: "Copper and brass elements are 'living finishes' and will naturally darken or develop a patina over time when exposed to air. This is a natural characteristic of the metal and not a defect."
2.5 Bulb Compatibility: "To achieve the intended aesthetic and light diffraction pattern shown in our photography, we recommend the use of clear vintage filament LED bulbs. Frosted bulbs may significantly alter the shadow-play of perforated shades like the 'Halo'."
3. Prices & Payment
3.1 The price paid is the price displayed at the time of order, inclusive of VAT.
3.2 Import & Duties: For UK retail customers, prices include all relevant UK import duties settled by the Company. For international orders, the customer is the "importer of record" and is solely responsible for any local taxes, duties, or customs charges applicable in their country.
3.3 Full payment for Products is required at the time of order.
4. Delivery & Lead Times
4.1 Glasgow Hub: Standard retail Products are stocked and dispatched from our Glasgow facility.
4.2 Lead Times: Standard items typically require 4–6 weeks for dispatch; bespoke items require 10–12 weeks. These are estimates only and are not guaranteed.
4.3 Heavy Handling: Substantial items (e.g., the 154cm Castile) may require curbside pallet delivery. Customers must ensure adequate access is available at the delivery address.
4.4 Force Majeure: We are not liable for delays caused by circumstances beyond our reasonable control, including supplier delays, transport disruptions, extreme weather, or other events outside our reasonable control. In such cases we will notify you as soon as reasonably practicable and work to fulfil your order as quickly as possible.
5. Your Right to Cancel (Returns)
5.1 Under the Consumer Contracts Regulations 2013, you have 14 days from the date of receipt of your order to notify us of your intention to cancel. Once notified, you have a further 14 days to return the item to us.
5.2 Return Shipping: You are responsible for the cost of return shipping for non-faulty items unless otherwise agreed. We recommend using a tracked service as we cannot accept responsibility for items lost in transit on return.
5.3 Exclusions: Bespoke, customised, or made-to-order items (including specific acid-etched designs such as the Acanthus or Damask) are excluded from the right to cancel and are non-refundable, as permitted under the Consumer Contracts Regulations 2013.
5.4 Products must be returned in their original, undamaged packaging.
5.5 Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.
6. Faulty or Damaged Goods (Claims)
6.1 Within 30 Days: If your product is faulty or not as described, you have the right to a full refund within 30 days of receipt.
6.2 After 30 Days: If a fault becomes apparent after 30 days and within 6 months of purchase, we will offer a repair or replacement as your primary remedy. If repair or replacement is not possible or fails, a partial or full refund may be offered.
6.3 After 6 Months: Beyond 6 months you retain statutory rights under the Consumer Rights Act 2015, though the burden of proof that the fault was present at the time of purchase shifts to you as the customer.
6.4 Transit Damage: Any damage in transit must be reported to us with photographic evidence within 48 hours of receipt. We reserve the right to decline claims reported outside this window where we are unable to verify the cause of damage.
6.5 We will cover return postage costs for items confirmed as faulty or damaged in transit.
7. Safety & Compliance
7.1 UK Standards: All fixtures are sourced from our specialised partners in India and are verified to meet UKCA/CE electrical safety requirements for the UK market.
7.2 Professional Installation: We strongly recommend that all Studio Scratch products are installed by a qualified electrician registered under Part P of the Building Regulations. Failure to use a qualified installer may invalidate your warranty and could affect your home insurance.
7.3 The Company is not liable for injury or damage resulting from improper installation, modification of the product, or the use of incorrect wattage bulbs beyond the stated maximum.
8. Our Liability
8.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Scottish or UK law.
8.2 Subject to clause 8.1, we are not liable for any indirect or consequential loss, including but not limited to loss of profit, loss of enjoyment, or costs such as electrician cancellation fees arising from shipping delays.
8.3 Subject to clause 8.1, our total liability to you in connection with any order is limited to the price paid for the Products in that order.
9. Disputes & Complaints
9.1 If you have a complaint, please contact us in the first instance at info@studioscratch.uk and we will aim to respond within 5 business days.
9.2 Alternative Dispute Resolution: In the event that we are unable to resolve a dispute directly, you may refer the matter to an approved Alternative Dispute Resolution (ADR) scheme. You may also use the UK Government's online dispute resolution guidance at www.gov.uk/alternative-dispute-resolution-non-court-procedures. We are not obligated to participate in an ADR scheme but will consider any reasonable request to do so.
9.3 These terms are governed by the laws of Scotland. Disputes are subject to the exclusive jurisdiction of the Scottish courts.
